TERMS AND CONDITIONS
- The bidder must register as a user and complete the KYC ('Know Your Client') to participate in any auction.
- Auction Online (PTY) Ltd reserves the right to refuse a user's participation at it's sole discretion, without the necessity of furnishing any reasons.
- All bids will attract a 10% buyers commission fee, plus 15% VAT on commission.
- Every bid shall constitute an offer to purchase. (Either by clicking the 'Place Bid' button, or any other form of bidding).
- The highest bidder accepted by the auctioneer shall be the purchaser, unless RESERVE or SUBJECT TO CONFIRMATION is applicable.
- All sales are done in one of the following manners:
- NO RESERVE - “no reserve” means that there is no established minimum price for the item being auctioned. This means that no matter what the winning bid, the owner must sell it for that amount; or
- RESERVE – “Reserve” means a minimum price that has to be reached for the bid to be accepted. If no bid equals, or exceeds the minimum reserve price, the goods may be withdrawn from the auction. In this case it will be mentioned in the description of the lot and may be relisted at a later date.
- All items are sold “voetstoots”, without any guarentees or warranties given by Auction Online (PTY) Ltd or the seller. The purchaser shall be deemed to have thoroughly examined the items and have accepted the condition and state thereof. Auction Online (PTY) Ltd shall not be liable for any minor errors in description of any items. (All goods may be viewed on a Saturday from 08h00 to 14h00) - Also refer to FAQ and Returns Policy.
- The auctioneer shall have the right to control, regulate and record the auction. The recording of the auction shall be prima facie evidence of the auction proceedings; both the bidders’ record and the vendor roll are available for inspection during normal business hours free of charge after the auction has been concluded.
- The auctioneer may accept or reject bids in his sole discretion without providing reasons. This includes rejecting an offer previously accepted by the auctioneer. In the event of a dispute between bidders, the auctioneer will have the discretion to put the lot up for auction again, and his decision shall be both final and binding.
- The auctioneer may, without penalty or prior notice, withdraw any item on auction at any time before the sale thereof or during the auction.
- The auctioneer will reserve the right to extend bidding time, should last-minute bidding wars occur.
- No “ringing” / “collision" between buyers shall be permitted, and if the auctioneer suspects that the bidders are involved in such activity, he shall be entitled to suspend- or terminate the auction, or to prohibit those bidders suspected of such activity from making any further bids. In this context "ringing" / "collision" between buyers, is defined as a group of buyers at an auction who collude not to bid against one another in order to keep the auction price low.
- The auctioneer is entitled to correct any bona fide error in the conduct or conclusion of any sale-, or arising from any incorrect information to the items for sale. In the event that the error is incapable of being corrected, then the auction shall be deemed to not have taken place, and no party at the auction will have any claims against the auctioneer or the seller arising from the cancellation of the auction.
- A sale by auction is complete when the auctioneer announces its completion by the fall of the hammer, or any other customary manner.
- Auction Online (PTY) Ltd reserves the right to activate bidding time extension ("sniper protection"), in order to give all buyers a fair bidding chance.
- Auction Online (PTY) Ltd endeavours to maintain accessibility to the site 24 hours a day, 7 days a week - but due to maintanance purposes, updates, technical difficulties, overloading of servers or bad signal from either party, we cannot be held liable for system downtime from time to time. Should this occur towards the end of an auction, we will try our upmost to resolve the matter as soon as possible and get the best possible resolution, however Auction Online (PTY) Ltd cannot be held liable for users not winning a bid.
- Risk on each item passes on to the purchaser on the fall of the hammer of a successful bid, or once a particular lot item closes, even though upliftment / delivery has not yet taken place. The purchaser shall bear the risk of items remaining at Auction Online (PTY) Ltd’s premises, in particular for any shortages or damage which may occur.
- Payment of goods purchased on auction.
- LIVE AUCTION – Full invoice amount must be paid to Auction Online (PTY) Ltd during, or directly after the conclusion of the auction, by method of cash, card or instant EFT..
- ONLINE AUCTION – Full invoice amount must be paid to Auction Online (PTY) Ltd no later than 48 hours after the conclusion of the auction, by method of Cash, Card, Instant EFT, or any other available payment method listed during online checkout.
- The purchaser shall remove his purchases from our premesis no later than 14 days after the conclusion of the auction, and only after full clearance of his payment as set out in the invoice has been effected. After 14 days, a storage charge of R30 per day will be charged. Goods not collected within 30 days, will be resold to cover storage cost.
- The purchaser regards these terms and conditions as binding, as specified during the announcements irrespective of whether he/she is present at the time such announcements are made. Special terms and conditions relating to each auction and to any of the lots may be announced prior to the commencement of the auction or during the auction.
